Attractive design in stores, transportation hubs and other public spaces is always desirable. For decades, most airline passengers waited for their flights in terminals with drab appearances and uninspiring food options. Now, many major airports, including Houston’s Bush Intercontinental, have undergone major overhauls to improve air travelers’ experience. However, aesthetic ideals should never take precedence over safety. 

Cyril Woods, an elderly Canadian man, was in the newly renovated Terminal D at Bush Intercontinental on May 6. Due to his mobility challenges, he was riding his electric scooter on his way to the gate after making a purchase at one of the concourse’s shops. Tragically, Woods apparently was unaware that he was approaching stairs. His scooter tumbled over, and he did not survive the fall.  

Lorna Woods, Cyril’s widow, has filed a wrongful death lawsuit against the City of Houston, claiming the stairs lacked any form of visible marking—such as signs, tape or paint—to alert visitors of the elevation change. She alleges this violates federal safety standards requiring that stairs be marked with a visual contrast at both the top and bottom.

This sad situation demonstrates that serious, and even fatal, slip and fall accidents might be the result of inadequate design. While many premises liability cases stem from temporary hazards, such as spilled liquid or broken pavement, there are some places that are inherently dangerous. Cyril Woods did not get hurt on a large stairway. In fact, there were only two steps leading downward. One potential area of inquiry in the wrongful death litigation might center on whether a short ramp should have been used instead. 

In describing her late husband’s injuries, Lorna Woods emphasizes the pain he suffered in between the time of the accident and when he passed away. This could lead to survival damages in addition to the wrongful death claim which addresses the impact of Cyril’s death on his family.
